Mediation

Experienced local attorney and mediator Brian Pugh is now registered on the Alabama State Court Mediator Roster and the Roster of Distinguished Neutrals.

Mediation is a very successful process for resolving civil litigation. Based upon recent reported mediation statistics in Alabama in Alabama mediation results in a settled case over 80% of the time that the process is used.In its 2024 statistics the Alabama Center for Dispute Resolution reported that 7,758 cases were mediated in Alabama and 6,803 cases settled for a settlement rate of 88%. For the period from 1997 through 2024 147,515 cases were mediated in Alabama and 119,537 cases settled for a settlement rate of 81%.

In mediation a trained neutral professional reads a pre-mediation statement, then meets with all parties in a civil case, listens to their summary of the history of the matter, reviews evidence and can provide objective and confidential analysis. Next the mediator functions as a trained and experienced facilitator who holds confidential caucuses with the parties and their lawyers in separate rooms as he or she delivers potential settlement offers. This mediation process can result in a prompt resolution or the parties may continue discussions or negotiations for several hours if progress occurs toward a resolution.
